CONSULATION ON DRAFT PERSONAL DATA PROTECTION LAW 25 JANUARY  
An updated draft of the proposed Personal Data Protection law was released by the Ministry of Digital Economy and Society on 22 January. On the afternoon of 25 January a consultation was conducted by the Permanent Secretary, Ministry of Digital Economy & Society (and her staff) for a small group of the foreign business community. Mr Bob Fox, the EABC Digital Economy / ICT Working Group chair (also chair of the  JFCCT EABC Digital Economy / ICT Committee) played a contributing role, along with representatives of Amcham, the Business Software Alliance and a number of tech companies. 

The draft law follows a fairly standard pattern and in most respects appears to be workable.  Gaps still exist however in the cross-border regime which is critical for Thailand’s status as possible data hub and some checks are needed to ensure harmony with the EU GDPR (General Data Protection Regulation*, which commences in May 2018). Submissions are due by 6 February; the Working Group is preparing additional recommendations.  EABC is grateful to the Permanent Secretary for the very useful event and the further opportunity to contribute.
 
*GDPR replaces the Data Protection Directive 95/46/EC. It is designed to harmonize data privacy laws across Europe and will impact European business in Asia. More
